The family of 83-year-old Ruth Murray is seeking legal action after the woman died Monday. Police say she was beaten by another patient at the Emerald South Nursing Home in Buffalo.

The family of Murray has hired Brown Chiari and the Ralph Lorigo Law Team to investigate her death.
Attorneys say the woman, who suffered from dementia had visited the cafeteria and then accidentally entered the room of a man, in his 80's, who also suffers from dementia.
Attorney Mike Scinta says Murray was beaten to death by the man. He also says the man has had prior incidents at the facility, including inappropriate contact.
"Our focus will be, where was the protection for this individual? Where was the protection for the other residents?"
Scinta says Murray suffered a fractured neck, fractured lower back, punctured lung, facial lacerations, and bruising.
The New York State Department of Health and the Buffalo Police Department is also investigating this case.
