ORCHARD PARK, N.Y. (WKBW) — The lawyer for Athletes Unleashed in Orchard Park says a judge has ruled that the gym is allowed to reopen at 100 percent capacity after it was initially fined $15,000.
Lawyer Paul Cambria tells 7 Eyewitness News that a judge found the fine and the closure to be "arbitrary and capricious."
In November, a video made its way around social media showing a confrontation between business owners and Erie County authorities at Athletes Unleashed.
A few days later, the Erie County Health Department fined Robby Dinero, the owner of Athletes Unleashed following that confrontation.
Later on that month, the gym filed a lawsuit against New York Gov. Andrew Cuomo and New York State alleging that the gym had been severely impacted by the pandemic, and was forced to cease its operations s as required by governmental order.
This following a racist email that surfaced from Dinero, resulting in the gym losing its CrossFit affiliation.
Cambria tells 7 Eyewitness News that other issues are expected to be addressed in February.
