BUFFALO, N.Y. (WKBW) — Zoom Tan locations in Erie County will be able to operate after winning a lawsuit against state and local officials.
According to attorney Terrance Connors, who represented Zoom Tan, the business "will be able to operate at full tilt without any risk associated with the transmission of the COVID-19 virus."
Zoom Tan's 13 locations in Erie County's "orange zone" were forced to close. The business claimed is it not a personal care business and did not present an "immediate risk."
The lawsuit was filed against several officials, including Governor Andrew Cuomo, New York State Department of Health, Erie County Executive Mark Poloncarz and the Erie County Department of Health.
