A man was shot with a rubber projectile during an argument in Delevan, police say, but both he and the man who allegedly shot him are facing charges.
Police were called to Cobb Avenue in the village Friday and found Jared Warzen, 21, had suffered a non-lethal wound from a rubber projectile discharged by a shotgun. Troopers say Warzen had been fighting with several people at that address and became combative with officers, injuring one trooper’s wrists, during their investigation.
Warzen was taken to Bertrand Chaffee Hospital for treatment and later transferred to Erie County Medical Center. Upon release, Warzen was charged with second degree assault, second degree harassment, third degree assault, resisting arrest and second degree obstruction of governmental administration. He was taken to Cattaraugus County Jail on $25,000 bail.
Troopers say Jaun-Luc Baker, 22, was the person who shot Warzen with a rubber projectile. Baker was arrested and charged with second degree assault, fourth degree criminal possession of a weapon and second degree reckless endangerment. He was also taken to Cattaraugus County jail on $25,000 bail.
