A man whose license is currently revoked for refusing a breath test while being arrested for allegedly driving drunk was again charged with DWI on Monday.
State Police checked a vehicle that went off the road on I-86 in North Harmony and say troopers could smell the alcohol on Kevin Cole. The 50-year-old Sherman man was arrested for DWI and a breath test revealed his BAC to be .23 percent, police say.
Cole’s license had been revoked for a breath test refusal during a prior DWI arrest, so he was additionally charged with felony first degree aggravated unlicensed operation.
He is due back in court at a later date.
