Family upset no charges will be filed against driver who hit and killed their son

It's been more than six months since a driver hit and killed 27-year-old Adam Olewniczak in a parking lot off French Road and Transit in Cheektowaga. 

Now, Adam's family has learned no charges will be filed against the driver who hit him.

"It's hard everyday knowing that my son's not here," said Adam's father Charles. "He was a big boy, you had to know.",

Cheektowaga Police say the investigation revealed there was not enough evidence to charge the driver.

It was early March when Adam was waiting for a ride home from a Cheektowaga bar when police say he was hit in the parking lot. Police say they found the car and the driver a short time later, and the driver was cooperative. According to police, the driver did not know he hit anything.

The Olewniczak family says something just doesn't add up.

"I don't see how you can run over a 225 pound person," Charles said. "They ruined my life, my family's lives, my relatives' lives," he said. 

The Olewniczak family says the DMV is holding a hearing next month on whether to revoke or suspend the driver's license.
