Shane Stevenson was charged with one count of first degree murder and two counts of second degree murder for the deaths of his girlfriend, 30-year-old Raina Voll and her 7-year-old son, Leo Klinger nearly one month ago at their Cheektowaga apartment.
Assistant DA Colleen Curtin Gable says, while the murder first indictment is rare, the Gran Jury found the more serious charge applicable given the nature of this case and will base their decision on all three charges at the end of trial.
A forensic examination will be completed prior to trial to verify Stevenson's level of competency moving forward.
The defendant plead 'not guilty' to all charges and is being remanded without bail at the Erie County Holding Center. If found guilty at the end of trial, he faces the maximum sentence of life without parole.
The next court date is set for December, 19 at 10:00am.
